Introduction

Welcome to CareStory. These Terms of Use ("Terms") govern your access to and use of the CareStory mobile application and related services (collectively, the "App"). Please read them carefully.

By downloading, accessing, or using CareStory, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

Eligibility

You must be at least 13 years old (or the minimum age required by local law) to create a CareStory account. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

Parents or legal guardians may create and manage health records for dependent family members, including minors, using their own account, and are responsible for that use.

Your Account

• Accurate Information: You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.
• Account Security: You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. If you enable biometric unlock, anyone whose biometrics are registered on your device may be able to access the App.
• Third-Party Sign-In: If you sign in with Google or Apple, your use of those services is also subject to their respective terms and policies.
• Unauthorized Access: Please notify us immediately if you suspect any unauthorized access to or use of your account.

Use of the App

CareStory is provided for your personal, non-commercial use to store, organize, and manage health records for yourself and your family members. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control.

You may upload or manage health records of another person only if you are that person's parent or legal guardian, or you have their permission to do so.

Medical Disclaimer

Important: CareStory is a health record management tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not intended for use in medical emergencies.

All content in the App, including AI-generated summaries, extracted details, health metrics, and reminders, is provided for informational purposes only. Always seek the advice of a qualified healthcare professional regarding any medical condition or treatment, and never disregard professional medical advice or delay seeking it because of something you have read in the App. In an emergency, contact your local emergency services immediately.

AI Features

CareStory uses Artificial Intelligence (AI) to read and extract details from prescriptions and insurance documents, and to generate summaries of your medical reports at your request. AI technology may occasionally produce incomplete, inaccurate, or misread results.

• Review Before Relying: You are responsible for reviewing and verifying all AI-extracted details and summaries against your original documents before relying on them.
• No Substitute for Professionals: AI-generated content does not replace the interpretation of a doctor, pharmacist, or other qualified healthcare professional.

Reminders and Notifications

Medication reminders, insurance expiry alerts, and other notifications are provided as a convenience. Their delivery depends on factors outside our control, such as your device settings, battery optimisation, network connectivity, and operating system behaviour. You should not rely solely on the App to take medications or meet important deadlines, and you remain responsible for managing your own medication schedule and insurance renewals.

Health Connect and Apple Health

If you choose to connect CareStory with Health Connect (Android) or Apple Health (iOS), the App will read the data you permit, such as step counts, to display your health and activity metrics within the App. You can revoke this access at any time from your device settings. The accuracy of this data depends on the source devices and apps that record it.

Your Content

"Your Content" means any documents, reports, images, prescriptions, insurance details, and other information you upload or enter into the App.

• Ownership: You retain all ownership rights in Your Content.
• Permission to Process: You grant us a limited licence to store, process, and display Your Content solely to provide and improve the App's features for you, as described in our Privacy Policy.
• Responsibility: You are responsible for the accuracy and legality of Your Content and for ensuring you have the right to upload it.
• Backups: While we take reasonable measures to protect Your Content, we recommend that you keep your own copies of important medical documents.

Prohibited Conduct

When using CareStory, you agree not to:

• Upload content that is unlawful, fraudulent, or that you do not have the right to share
• Access or upload another person's health information without proper authority or consent
• Impersonate any person or misrepresent your identity
• Attempt to gain unauthorized access to the App, its servers, or other users' accounts
• Reverse engineer, decompile, modify, or create derivative works of the App, except as permitted by law
• Introduce viruses, malware, or any code intended to disrupt or damage the App
• Use the App for any commercial purpose or in violation of any applicable law

Privacy

Your privacy is important to us. Our collection and use of your personal and health information is described in the CareStory Privacy Policy, which forms part of these Terms.

Third-Party Services

The App relies on certain third-party services, such as cloud storage, authentication, analytics, crash reporting, and AI processing providers. Your use of third-party services (including Google Sign-In, Apple Sign-In, Health Connect, and Apple Health) may also be subject to their own terms. We are not responsible for the availability, content, or practices of third-party services.

Intellectual Property

The App, including its design, software, features, text, graphics, logos, and the CareStory name, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited licence granted in these Terms, no rights are transferred to you.

Fees

CareStory is currently offered free of charge. If we introduce paid features or subscriptions in the future, the applicable pricing and terms will be clearly presented to you before you make any purchase.

Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure, or that AI-generated content, extracted data, or health metrics will be accurate or complete.

Limitation of Liability

To the fullest extent permitted by law, CareStory and its owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health outcomes, missed reminders, or decisions made based on content in the App. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless CareStory and its owners, affiliates, and service providers from any claims, losses, or expenses arising from your misuse of the App, Your Content, or your violation of these Terms or the rights of any third party.

Suspension and Termination

You may stop using the App at any time and may request deletion of your account and associated data by contacting us using the details in the Contact Us section below.

We may suspend or terminate your access to the App if you violate these Terms, if required by law, or to protect the App or other users. Upon termination, your right to use the App ends, and your data will be handled as described in our Privacy Policy.

Changes to the App and These Terms

We may update, modify, or discontinue features of the App from time to time. We may also revise these Terms. Material changes will be published within the App or on our website with an updated Effective Date. Your continued use of CareStory after any changes constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of CareStory shall be subject to the exclusive jurisdiction of the competent courts at Ahmedabad, Gujarat, India.

General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right does not constitute a waiver of that right. These Terms, together with the Privacy Policy, form the entire agreement between you and CareStory regarding the App.
